#futureGCstudent Contest Rules

The #futureGCstudent Contest (the “Contest”) is open to residents of the Province of Ontario 16 years of age and older. Any winner under the age of 18 must have a parent/guardian sign an affidavit of eligibility. The Contest is not open to employees of the Georgian College of Applied Arts and Technology (“Georgian College”) or persons with whom they are domiciled.

By entering this Contest, each entrant acknowledges that he/she has read and understood the rules set out below (collectively the “Contest Rules”), and accepts the Contest Rules and agrees to abide by the governing terms and conditions:

1. HOW TO ENTER: No purchase is necessary to enter. To participate in the Contest, you must:

a. Have a valid Instagram or Twitter account (an “account“). If you do not have an account, visit www.instagram.com or www.twitter.com and register in accordance with the enrolment instructions for a free Instagram or Twitter account.

b. During the entry period, send a message using your account, which contains all of the following elements (together, an “entry“):

(i) a photo taken by you at the Georgian Preview event on April 5, 2014 (any submitted photograph displaying a disregard for safety or depicting unsafe or dangerous practices or acts will not be accepted),

(ii) the #futureGCstudent hashtag, and

(iii) the photo and any additional text in an entry must:

  • not contain any commercial content that promotes any product or service,
  • not be false, inaccurate or misleading,
  • not violate any law or regulation,
  • not instigate others to commit illegal activities or violate human rights,
  • not contain any viruses, worms, or other interfering computer programming,
  • not be libelous, threatening or harassing,
  • not defame, misrepresent or contain disparaging remarks about Georgian College or its products,
  • be in “good taste” and in keeping with the Georgian College’s brand image and must not be explicit, offensive, obscene or profane, and must not be derogatory toward any ethnicity, race, gender, sexual orientation, religion, profession or age group, or promote any activities that may be unsafe or dangerous, as determined by the Georgian College, in its sole and absolute discretion,
  • not violate the rights of any third party, including but not limited to privacy and intellectual property rights. For example, your message must not defame, infringe or violate publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s, entity’s or organization’s personal or proprietary rights. For greater certainty, your message must not contain copyright works, trademarks, logos or trade dress owned by anyone other than the Georgian College, or advertise or promote any brand or product of any kind, without express, written, prior permission of the trademark or brand owner, and
  • comply with terms of service and rules of Instagram or Twitter, depending on the platform you use to post the photo.

2. ENTRY TERMS: The Contest opens at 7 a.m. (EDT) on April 5, 2014, and to be eligible, entries must be received by 8 p.m. (EDT) on April 5, 2014. No purchase necessary. Maximum three (3) entries per person. Multiple (i.e., more than three) entries from the same person will void all entries from that person. For greater certainty and the avoidance of any doubt, you may use more than one (1) account to participate in the contest but the total number of your entries may not exceed three. Use of any automated system to submit entries is prohibited and will result in disqualification.

BY SUBMITTING AN ENTRY, YOU ACKNOWLEDGE THAT YOUR ENTRY (INCLUDING YOUR USERNAME AND PROFILE PICTURE) MAY BE POSTED ON TWITTER, INSTAGRAM, FACEBOOK, OTHER SOCIAL MEDIA PLATFORMS, AND/OR GEORGIAN COLLEGE’S PROPRIETARY WEBSITE, WHERE IT MAY BE VIEWED, SHARED (BY SOCIAL MEDIA USERS AND VARIOUS OTHER INTERNET-BASED SITES) AND COMMENTED ON BY GEORGIAN COLLEGE AND THE GENERAL PUBLIC.

3. CONTEST JUDGING AND NOTIFICATION: Odds of winning depend on the total number of eligible online entries. The winners will be selected by a panel of judges (to be determined by Georgian College) based on creativity, originality and adherence to the Contest Rules. All eligible entries received within the Contest dates will be scored. In the event of a tie, a winner will be randomly selected from the tied entrants. Judges’ decisions are final and not subject to appeal.

The winner will be determined at 1 p.m. in Barrie, Ontario, on April 7, 2014. Georgian College will contact the selected entrant by sending him/her a message to his/her Instagram or Twitter Account. The selected entrant must reply to the message within 72 hours (the “contact period”). It is the entrant’s responsibility to set his/her account settings to accept messages from Georgian College and to check his/her Instagram or Twitter account(s) for such messages after 1 p.m., April 7, 2014.

The selected entrant will be required to sign and return the Contest documents described in Section 6 within 10 business days of notification. If a selected entrant: (i) cannot be contacted within three (3) attempts or before the end of the contact period (whichever occurs first); or (ii) if there is a return of any notification as undeliverable; or (iii) fails to return the Contest documents within the specified time, (iv) otherwise does not comply with these Contest Rules, he/she will forfeit his/her prize and an alternate winner will be selected.

In the event of a dispute regarding the identity of a participant’s entry, the entry will be deemed to have been made by the authorized holder of the social media account at the time the entry was made.

5. PRIZES: Four Contest “Winners” will each win a gift card to the Bear Essentials Store, part of Georgian Stores in the amount of $100.00 to be applied toward eligible purchases at the Bear Essentials Store, part of Georgian Stores, www.georgianstores.com. The prize must be accepted as awarded and may not be transferred or exchanged or combined or used in concert with another contest or another offer. The prize cannot be converted into cash or substituted for another prize.

6. CONTEST DOCUMENTS: The winner, or the winner`s legal guardian if the winner is under the age of 18, must sign a document including (i) a declaration as to eligibility, (ii) a publicity release (iii) a liability release, releasing Georgian College, its Board of Governors, its advertising and promotional agencies, the affiliates and related entities of the foregoing and all respective directors, officers, partners, employees, agents, representatives, successors and assignees from any liability in connection with this Contest or the prize awarded, (iv) a declaration that he/she is the author of the entry and that the entry is an original work, (v) an assignment all intellectual property, including copyright, in and to his/her entry and waives his/her moral rights therein in favour of Georgian College (vi) an agreement to indemnify Georgian College against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her entry including, without limitation, any claim that his/her entry infringes the intellectual property or other proprietary interest of any third party,

as a condition to and in advance of receiving the prize, or the prizes will be forfeited.

7. ELIGIBILITY: Georgian College reserves the right to verify if the winner satisfies all Contest admissibility criteria. Georgian College’s rulings are final and without appeal in all matters related to the promotion and the awarding of the prize. Any dispute relating to the Contest (including, without limitation, a dispute as to whether an entrant has complied with all of the Contest Rules) shall be resolved by Georgian College in its sole and absolute discretion. All decisions of Georgian College shall be final and binding.

Any use of robotic, automatic or programmed entry methods shall be deemed as tampering and will void all entries by that person. All entries that are incomplete or irregular that have been submitted through illicit means, or do not conform to or satisfy any condition of the Contest Rules may be disqualified by Georgian College. Georgian College takes no responsibility for delayed, misdirected or late entries, or for typographical or other production errors. Georgian College is not responsible for any errors or omissions in printing or advertising this Contest.

All entries, including photo submissions, become the property of Georgian College. Entrants agree to allow Georgian College to use the photo submissions in print, digital or web-based formats for promotional and archival purposes. Entrants’ and winners’ contact information will not be shared with any other outside parties.

8. ONLINE ENTRY: Georgian College assumes no responsibility for failure of the internet, social media sites or the Contest website during the Contest, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any message to send, failure of any message or attachment to post to Twitter or Instagram, or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Georgian College reserves the right in its sole discretion to cancel or suspend the Contest should a virus, bug or other cause beyond its reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Georgian College reserves the right to seek remedies and damages to the fullest extent permitted by law.

If the identity of an entrant is disputed, the authorized account holder of the Twitter or Instagram account submitted at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder associated with the selected entry and the time that the social media message was sent. The determinant of time for the purposes of receipt of a valid entry in this Contest shall be at the discretion of Georgian College.

9. GENERAL: This contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. By entering the contest, participants agree to be bound by these official rules and by the decisions of the contest judges, which shall be final on all matters relating to this contest. All entries become the property of Georgian College and none will be returned. The personal information provided by entrants will be used only for the purpose of administration of the contest, unless the entrant otherwise agrees.

This contest is in no way administered, sponsored or endorsed by Instagram or Twitter. Any questions or comments regarding the contest should be directed to Georgian College.
